I know the screen size is different, but is there any software / updates you can buy for the old ipod with colour screen / album ... to make it do what this brand new ipod does (i.e. video?)

I feel gutted for my sister. It's her birthday today so my mum bought her a new ipod 60 gb about a week ago, so it was here ready for her b-day. But yesterday (the day before her b-day) the new ipod with video is released for the same money spent on the ipod 60 gb

So effectively if she had waited till now, she would have the video one.

no the ipod photo does not have the hardware capability to play back video, whatever the video format is, which will probably be MP4 of sorts, or some kind of QT file. so no shes stuck with the boggo photo/music capability im afraid

Yeah take it back , say its not the one she wanted and it was the video one, just argue it through.

Yeah u should be able to arguie that you paid over the odds and for an out of date piece of equipment... try it kick up a massive fuss too!

Take it back & exchange it for the new one, most places given you 21 days from purchase to exchange unwanted items

by law if you want to return it they have to take it back as long as its unopened

No this is wrong, the law states:

If something is purchased in error or unwanted as a consumer you are stuck with the item & the retailer doesnt have to take it back, however some retailers find this rule too harsh so they offer an exchange policy.

^^ Correct, they only HAVE to take it back if its faulty/damaged etc (statutory rights)

Isn't there a law about it being fit for the purpose as well? Say it doesn't play loud enough or something!

Yes but that basically means its faulty etc but i suppose it would be worth saying its not fit
