they are refusing to cancel my contract because i apparently sent 1 text yesterday off my phone which i have no knowledge of at all, cause all i did was turn the phone and and use the menus and it sat on my desk the rest of the night
where do i stand?
by the way i receieved the phone yesterday and rang just to send it back but they wont accept it.
I have been given the customer complaints address i have to write to (no number)
but where do i stand? cause im not paying for something im never going to use again.

I paid for an 18 month contract with o2 without using the phone once.
Shit happens, you should read contracts I guess.

tell them you will pay for the text if its that much of a problem, i thought you had a 14 day cooling off period.
and the text should be in sent items if the phone actually sent one, also they can tell you who the text was apparently sent.... ask them for full details

You have to pay an unlock fee and the cancelation fee apparently according to their T&C's. Nothing about a cooling off period

Is it a Nokia phone?
Googled that phone number and came up with this:

What phone is it?
You could sell it on ebay and buy another one with the money to continue using the contract

Ring them back and speak to a manager about the number being a club nokia number which you were sent a text by without you agreeing to it.
Kick up a fuss, although it serves you right for going with such a shit company anyway imo
