as long as you dont have 1 of the 2 you'll be ok.
I.e belts but no seats, or seats but no belts

Yeh but it will be classed as an advisory/ or worse a fail if the MOT tester doesn't like the idea of it

they cant fail it as theres not anywhere on the mot computer to fail it for having belts but no seats

Legally they should test the number of seats the same as what your logbook states. If you remove the rears and the logbook still says 5 seats then it should really fail.
If you get the logbook changed and declare 2 seats yuo will pass, but add them back and not change the V5 too and that would also be a fail.
TBH, they don't go by the letter of the law so removing both belts and seats and not changing the V5 will get you a pass.
I would rather lose by a mile because i built my own car, than win by an inch because someone else built it for me.

my 5 door astra passed today, no seat belts, no rear seats, just two buckets and harnesses
