crash related:

who is at fault in this senario - car driving along the road at the speed limit, another car creeps out of a juntion, car driving along the road brakes but hits the car who came out the juntion?

cheers everybody, some guy creeped out a junction as he couldnt see and my sister hit him, hes now trying to tell me it wasnt his fault with his mum in the background telling him things to say

Did your sister take pictures at the scene.

It's a no brainer if it goes to insurance, i'm guessing it wasnt blind, he could clearly see, she wasnt speeding, his fault

If you enter the path of another vehicle, you'll have a hard time defending yourself when they hit you.

What exactly was his claim? She was going too fast for the conditions or something?

he said it was her fault becuase he only creeped out the junction and she was going fast locked up and hit him

but she assures me she was doing 20mph due to the conditions

I told him on the phone even though she hit you, the one to blaim is yourself as if you hadnt came out of the junction the crash wouldnt have happened and she had right of way, tbh he sounded very shaken up and his mum didnt sound very happy

Its natural to want to defend yourself. I just don't think he has a clear case. Being careful or otherwise, he still entered her path.

Yeah, I could hear in his voice he was obviously worried about it and I told him in the insurance's eye's you will be at fault but he still didnt see it

All good now, her cars away and her courtesy car is coming tomorrow

Damage consists of (according to my sister) burst radiator, front bumper smashed and completely off, both fog lights dead, one wing dead, one wing bent, headlights pushed back, and bonnet caved in.

if so, if a picture was taken at the scene, the owner of the car causing the lack of visability could also be held to blame.

You might get some prosecutions for obstruction or something, but I doubt you could pass the blame to someone who owns a car that wasn't moving.

there is indeed, but the silly police turn a blind eye to it.

if i had my way, every fucker who does this would get a ticket. my dad included.

definitely the other lads fault. some guy wrote my corsa off doing that, except he didn't get all the way out and hit the side of the car.

he tried defending himself using the old young boy racer type crap but in the end i won

Tbh im hoping they write it off, as I wanted her to sell it and buy a corsa

Also I reckon the guy (who I have a feeling was in my year at school) didnt know what to say and was just taking advice from his mum

hers is a V plate 206 with 61k or 63k on the clock
