Hi guys,

I've received a court summons for supposedly not sending the V5C to the DVLA.

The car was sold in June 2011 and I 100% sent the V5C back 1st class post with the new keeper details.

Has anyone else been in this situation? It says I can plead guilty and not have to attend court but also says the cost could be upto £1000.

Personally I normally avoid anything like this even when in the right by paying, however in this case and the fact it's the DVLA I feel like fighting it.

Any help appreciated.

Why should you plead guilty if you did as you should have?

It's not your fault they haven't received paperwork you sent.

Happened to me except it wasn't a court summons, it was just a fine, I just called them and told them it was done and never heard anything else.

This is what i'm thinking, if it was £30 i'd pay it and be done with it, have to much going to mess around with money robbing companies.

From what I can find the moment I drop that V5C in the post box i've forefilled my legal obligation in regards to notifying them of a change of keeper.

IT says:

Statement of facts:

On the 01/06/2011 the defendant having previously kept motor vehicle ******* failed on the change of keeper of the vehicle, to notify the secretary of state, forthwith, as required by regulations.

The maximum penalty £1000
The prosecutor will ask for a minimum £60 contribution towards legal costs.

Exactly. Tell them that. If its an issue they can argue in court and waste more of their money.

must have 'got lost in the post'.

phone the dvla up, explain the situation and see what they say.

seems a bit harsh.

mine got lost in the post too. i rang up paid £60 and that was that.

Did you get a court summons?

I've had no details for paying a fine, the first I've known about this is a summons.

Do they send out reminders or anything to say you've not done it? Seems a bit harsh with the first letter being a summons to court

If they have sent any reminders I haven't received them.

It seems a few people when searching on google also had a summons with no reminder.

My other problem is, I'm at Thruxton all that week testing, I assume they can't reschedule.

Dont turn up, it will get sorted in your absence, and you will get a £130(ish) fine

happened to me with my bike, had a copper come and post a court summons, phoned them and said it was just a fine of £125. the V5 was def sent because was done with my companys post bag

So you rang the DVLA office who had issued the summons and paid or rang the court?

Reason I ask is I have 4 days work away that week and rather pay a small fine than loose out on that.

I just left mine, got a letter saying how much the fine was, got a card and went into a shop and paid it off as and when i wanted to

no i had to phone the police who put me in contact with my local court, had to post the cheque to the court because they wouldnt accept it off me or let me put it thru the letter box,

stupid question... if you never notified them of changing owners... how do they know

also just give them a call and tell them what happened (dvla)

Happened to my dad except the dealer never changed the name when he sold a car to them, he got the fine...there is no arguing with the DVLA they won't listen.

This is why I always send recorded now. Got stung with a fine years ago. They seem a little harsher these days though!

I rang up, told them i forefilled my legal obligation and how I did so.

They're dropping the case and all charges.

I had a letter the other day asking me to tax a scrapped car. I proved it was scrapped and they still tried to fine me so I declared it SORN again. Stupid system.
