say you bought a car with a private plate, owner failed to complete the relevant docs and send them off but he did mention he wanted to keep the plate.
then the new owner has to sort the new registration docs out himself and does so with the private plate that was sold to him with the car and keeps the plate.
but the old owner wants to put it on his car months later.
what would the legal situation be?

If he has the papers saying he owns the plate then its his if you have them its yours.

I don't particularly want to get too involved, but...
technically, the plate belongs to the new owner of the car.
morally, however, if there was a verbal agreement, then the plate should be transferred back to the original owner.
and, iirc, a verbal agreement counts as a legally binding contract.

Legally the plate is yours.
The DVLA advise you to transfer any plates before the sale of the car otherwise the plate belongs to the new owner

TBH, I think if the old owner is willing to pay the transfer fee, its only fair that he gets the plate back, if the return of the plate was agreed before the sale of the car...

yeah would agree with you.i bought a golf with a private plate on it and let them have it back.

well that isnt my decision any more, I have since sold the car on. its now on the road with that plate on the insurance, tax disc and MOT certificate

yeah, but all that is sorted with the £80 transfer fee, so your man won't be losing out, especially if the old owner buys him some shiny new numberplates

yes, the old owner was given nearly 3 months to sort the documents out but nothing was done about it.
also, its not just an £80 transfer fee now its the hassle of getting new plates, new MOT certificate, changing the insurance details (£20 fee on that) andgetting a new tax disc.

tax disc and mot cert are sorted by the dvla, inclusive of the £80. get the old owner to pay the £20 for the ins cert, and the new plates...
i can see where you're coming from, that there was enough time to sort it, but it was agreed, and it's not actually any hassle or effort on the new owners part.
would you not be better discussing this with the old owner anyway?

well I dont want to get involved at all. Its not my car or my responsibilty anymore. Its between the new and old owner as my name never went on the docs anyway.

yes, he had enough time to do it before it was re-registered, but i expect the plate means alot more to the original owner than the new one, so I don't think the new owner should be that fussed if all costs are covered and the previous owner deals with the DVLA etc...

well the old owner was contacted 3 weeks ago and told that the car was going back on the road with that plate.
they didnt repsond.

I done this a few months back, sold the corsa thinkin I could change the plates over even if the car wasnt mine, bad idea had a nightmare gettin my plate back due to my stupidity but the lad I sold it to was honest enough and done it for me once I sent him all the fees

is the new owner aware of the situation with the plate? if not they prob wont car but if they were then they should prob just let the old owner have it,

after speaking with both parties involved I am sure that they will reach a friendly agreement over it.
if you have a private plate on a car that you want to sell, get the old reg on before you sell it otherwise it cause a whole load of trouble

Only reason i didnt get the plate off was because of the fact it would of taken ages and you wanted the shell straight away.
If you wanna be arsey about the plate then keep it i dont have the money to buy it back like you said in the U2U "You can buy it back for £475 its valued at "
You also got a nice new exahust with the car along with some other stuff your on about all this tax disc and MOT bollox none of that is upto you DVLA sort it

Well tbh, I dont think getting things done is your strong point Rob... I'm not being "arsey" but im still waiting these documents for a car that I have sold!!! If anything happenss... i.e speeding fines you could be held responsible which is why ive contacted you this week.. so please get back to me.
