The provisions of section 22 PACE regulate the retention of property seized for the purposes of a criminal investigation. The court can direct the return of the property to the accused or his nominee if to do so would be consistent with the interests of justice and the safe custody of the accused.

Retention of the property should be justified within section 22. In particular consider whether any items are required as exhibits.

If you do not know whether the items may be relevant as exhibits nor whether there are rival claimants you should invite the court to adjourn the matter pending clarification.

The police can retain property which is identified as being stolen or otherwise unlawfully obtained, but they cannot do so in respect of property which is the absolute property of the accused merely because in due course a restitution, confiscation or forfeiture order may be made.
