My mini - the classic. To cut a very long story short, it was taken for repair last March to a now retired Mini Specialist. It lay in his yard for 9 months waiting on him getting around to fixing it. Eventually the week before Christmas after a few angry words with him, he phoned to say it was sorted, the cost was £460 and he needed cash as a cheque was no good to him at that time of year and he needed it before Christmas Eve!!
We hadn't time to arrange a low loader to get it home, so mum went to him on Christmas Eve, paid him the cash and asked if it was ok to leave it there until we got transport arranged to get it home. He said that wasn't a problem and to give him a buzz when we were coming to collect it.
We never managed to get for it, my gran was very ill and died 3 weeks ago and tbh the mini was the last thing on our minds..However mum emailed him last night to arrange pick up this weekend, He has emailed back saying that will be fine, but we owe him £40.00 storage charges (£10 per week) and that he'll let us off with February's!!  Bearing in mind it lay in his yard for 9 months waiting on him getting around to fixing it in the 1st place, and during this time the MOT, Road Tax and Insurance all ran out, hence why we now need a low loader to get it home !!  He never once mentioned storage charges when he agreed to keep it there for us, infact he said it wasn't a problem, as long as we had settled the account he was happy to keep it for us
We've no intention of paying, but what if he refuses to hand over the keys when we go to collect it at the weekend? Colin says he'll batter him about the yard, where do we stand?

Garages can charge a storage fee, its £40 or hassle & arguments. I know what i'd choose

It's principle of the thing, if he'd fixed it in a reasonable amount of time it would still have been road legal and we could have driven it home on Chrismas Eve when we paid him. It took him 9 long months to get off his ass and sort it, I think we were more than patient with him and then he hits us with this, he's ripping the piss

Its shit but I'd just pay it and be done with it. If it was £100 or something I'd kick off but dont think its worth it for £40

Im sorry I wouldnt pay for it. It took him 9 months to get a move on, and he moaning about 4 weeks. He isnt a garage anymore so legally he cannot charge for this.
Strong letter stating a date you will be picking the car up on. If he refuses, call the police. Because he isnt a garage he cannot refuse to release the car if you have paid him.

On a serious note, i'd offer him £20. Point out that he's working illegally, he had your car for 9 months, you have paid him for the work done and that you have had family problems.

Ask for a VAT receipt.
That will get him panicking - he should declare the £460 and £40, but I bet you he won't.
If you can't get the car without paying it, then ring the Inland Revenue or whoever and say he is not declaring earnings

In theory was it not just a friend doing you a favor??
You won't of had a reciept of any kind will you??
If not legally you wouldn't of had to pay him a penny for the work as there won't have been any legal binding contract between you.
I.E. When a car is taken to a registered garage, a repair card is written out and legally you should sign over the car for them to repair. If you haven't you could've taken the car for nothing, lets face it it's your property not his and thats final in the eyes of the law.
Don't give him anything but grief, he sounds like a loser
