My sister was involved in a 3 car pile up today. She didn't have her foot on the brake and when hit from behind has gone into someone else. The 3 day year old KA will be written off for sure..
Who is to blaim that she went into the back of the other car? Silly cow has told the Police she had her foot off the brake.
Main thing is that she is alive and not too badly hurt!

What happened when this happened to my brother was the car infront claimed off him, his insurance then claimed off the car behind (that hit my brother) for his car and the car infront. It was something along those lines, it went down as a non-fault...
"maybe" just maybe... she had her foot off the brake because she was about to pull away just before the impact?

your not meant to have your foot on the brake, your meant to have the handbrake on i think, and a car can be pushed with the handbrake on.

Indeed, ready to move off.

so she was in the middle?
i'm assuming she's gonna be liable for the car she got pushed into, cause she didn't keep her distance from the car infront.

Doesnt matter if your foot is on the brake or handbrake on etc its the person who pushed them togethers fault. I have recent experience in this exact same thing unfortunatly.

She got hit at motorway speeds. She stopped but the car behind used her car as a brake

Doesnt matter about brakes. If your in a pile up you pay out for the car you hit.

But you then claim it off the driver that hit you

Well I didnt know about that. It would be argued that you didnt leave enough space between you / car you hit.

Surely the insurance company cannot argue about not leaving enough space at 70 MPH

Typical stopping distances when in dry conditions (Source: DSA)
70mph= 21m of thinking distance and 75m of braking distance – This is equal to 96m or (315 feet) or twenty-four car lengths.
I think that can be used as a loophole against shifting responsability.

24 car lengths so if someone cuts into that space and then someone hits you from behind and you hit the car infront who just cut in, then what?
loophoes and silly laws all over the place i assume.
