had a phone call with them earlyer and they are writing the car off as a total loss, they have made an offer of £2500, now i know people always tell you not to accept the first offer but this is the avarage price that these cars are selling for from a dealer. what should i do? take the first offer or hold out an try and get a little bit more, top end price for this car on this year is around £2750

No harm in asking if they are willing to increase their offer - it'll either be yes or no.

Are they claiming off the other party's insurance?

I'd be happy with £2500 then but that's just me. You will get a decent payout as well so it's a win win situation.

Accepting the offer may result in a fairly quick payout. If you request more you may get it but could inccur a lengthy delay until/if it is agreed.

Well it's not quite win-win Andrew because she/they've been injured, they are now with one less car and also have to deal with the process of getting a replacement car, medical related matters and having a claim which might affect future insurance premiums depending on whether they have protected NCB or not.

it wont affect my ncb as the accident wasnt my fault and the 3rd party insurance are paying

ita abit shite though that i have 7 days after the cheque has been sent to replace the car because they will take the hire car off me, it might take 2 days in the post and 5 days to clear in the bank, better get looking now then for a new car

Yes this is true and if liability is disputed for any length of time then your NCD will be reduced until the claim is settled.

If it is a clear cut case and liability is conceded by the other side the the NCD will stay as is.

Ultimately in a non fault claim it does not affect your NCD, nor does it affect your premium when you declare a non fault accident.

I have been through this process twice.
