Had an incident this morning and was wondering if people would say if this is 100% the lorry drivers fault. He hit the drivers side rear.

Silver being me - Blue being the lorry




Not too much damage just creased the rear quarter

From that it's his fault.

Depends how much common sense you used when going up the inside of a lorry though when from that roundabout he could have only been going the same way as you.

Be lucky for 50/50 though.

Looks like he was at fault. It's one of those irritating layouts though. There's a couple round here where people get into the wrong lanes and cut across without checking properly. I can imagine the insurance being a pain about it while they look into it. Did you get any witnesses?

I gave my details to the owner of a MX5 who had a similar thing happen and I did the insurance pack when it came through.

was always in front of him. Sounds like they dont wish to go through insurance though as they want me to get some quotes on a repair.

No witnessess either. 8:30 in the morning busy roundabout there isnt many people that would stop anyway!!

highway code states you need to leave room for long vehicles. if he disputes it and it goes to the hands of insurers it'll go 50/50

For a lorry firm for a bashed panel it's probably easier to pay you off then get their insurance involved.

leave room? If the lorry is in a different lane how can i possibly give him enough room behind me just incase he wants to get in the lane im in?!

partly yours the lane you were in entering the roundabout i'd say was only for the first 2 exits

depends on what the road markings say though

watched a very similar incident on police camera action (or something like that) the other day.

They had cameras in with the lorry driver to show just how easy it is for them not to see you etc and stressed how much common sense people should use then they're along side them etc.

It went 50/50

from looking at that it looks more your fault than the lorrys, the lane you was in entering the round about was to go left and straight on, not right like you have done.

The lane is marked straight on and right.

the one he enters the island from is left and straight on, the one the lorry enters from would be marked straight on and right.

The left hand lane is marked A5460 too (from what I can make out).

how i see it, if the lorry was turning right he should have pulled straight into the middle lane, you should have been in the same lane as him

VrsTurbo was in the right (left) lane and did nothing wrong (if the left hand lane is marked A5460)

The lorry could have been in the left hand lane to begin with, but obviously decided to change mid roundabout without checking to see if it was clear.

100% the lorrys fault, you were in the correct lane, the lorry moves over and side swipes you.

regardless of what lane you are in the lorry should of checked before making the manouver
