Girlfriends just had a rather bad smash. She's ok though that's the main, cars fucked (the silver megane)

Question, she has pulled out of a junction, car coming along the road was goin too fast and smashed into side of her. Police said its her fault as she's pulled out.

Also she will have to claim and the megane will be written off, can she claim whiplash on her own policy and will it make it go up more for future? Obviously I know it will go up due to accident.

Her fault. Yes she can claim. The amount claimed for won't make any difference I don't think.

It will make a difference to other peoples premiums though, please don't claim unless she has genuine injury.

unfortunately speed isnt a contributing factor unless its proven.

dont think she can claim compensation off herself though

She is injured Steve, bruising all over shoulder side and hip. She wouldn't claim if it would cost her is the reason.

If I put a pic up you'd see why she was hurt.

In fact, I can't see her before ng able to claim. If you were allowed to claim off yourself for injuries then what's to stop me having a bump when I'm a bit skint

Ill put some pics tommorow. Out at moment. Bruised a fair bit so no doubt tommorow will be worse. Cars deffo fucked though. Right mess.

You can't claim if it was your fault, unfortunately.

The only people who can claim are passengers in the at fault parties vehicle and anyone in the third parties vehicle.

She will get the blame. My mate had the same thing happen. His gf had her pelvis broke they was hit so hard. He got 6points and a banned. His insurance is about £3000 on a fabia vrs diesel. Hope she recovers quickly though.

Yeah you can't claim if it's your fault, only the passengers in the vehicle can.

Sorry to hear about her injuries.

Unless she's able to place negligence with the other party then she has no basis under which to claim anything.

Its not money because you're hurt. Its money because you're hurt through no fault of your own.

She'll have a difficult job proving the speeding. Presumably if a speeding conviction is not already under way then there's no question at this stage of obtaining one.

Very unfortunate incident, sorry to hear it but like said use won't be able to prove the other car speeding so will go down to being her fault so use won't be able to claim for her injuries.
Feel for use when wasn't really her fault just some bellend speeding and getting away with it, main thing is she's ok though

Junction she was coming out,



The black Leon was coming from where the police cars are. Megane was turning right.




Spun it round, smashed alloy into curb, I thought it had bent the axle but looking at it it has snapped the hub and disc clean in half!!!






Can see wheel is smashed and early holding on.



And the Leon.



Can see was clearly not doing 30mph but unfortunately can't probe anything!

Bruising on shoulder from seat belt around an hour after.



Is worse today and a lot of bruising on her hip.

Fuck the car as long as she's ok

based on his realtive lack of damage you could argue he might have been doing 30, i would if he was my client (sorry)

yeah you might manage that, on the basis that your damage goes part of the way to prove his speed was excessive for the road.
however unfair it is though, the law isnt on your side and places 100% fault on your mrs.

because you have to visit a Doctor to prove the claim of injury...so you'll need more than a "bump" for a valid injury

Looks like she was more than 50% across the road by the time he hit her from looking at the damage.
Surely excessive speed is obvious from the amount of damage done to the megane.

Surely the other cars speed is basically irrelevant. She pulled out from a minor road onto a major one without allowing sufficient time to complete the manoeuvre.

Even if there wasn't a give way sign, the priority is still given to the main road.
