just a queston to see whos fault it is.
i was parked outside a shop on the right hand side of the road and i was pulling out and i saw a car come 2wards me. i stopped. he braked slowley and hit the front right of my car caving it all in.
am i right in thinking that since i was stopped, not moving what ever that it isnt my fault.
He could have gone round me. coz tere wasnt anycars coming from the other direction?

Did he have time to stop?
Is always best to call the police in an accident cos they can decide who was to blame and it speeds up the claims..

indicating : yes but he couldnt see the left side of the car.

it was in daytime, but its raining. + i have got atleast 4 witnesses saying that i was stationary.. will this help?

might be a tricky one, someone pulled out into me a couple of weeks ago, i couldn't of avoided em, and its ended up being all her fault...

have to be indepdent witnesses, ie: not a passenger in yer car...

Were you more than a doors width into the road?
Your insurance company should argue that the highway code states to leave a doors width when passing parked cars!

well u see he could have gone round me and there was no traffic infornt of him so i dont see how he could have missed me.

At the end of the day you pulled out in front of the car. If you have witnesses saying the car should have had enough time to stop but didnt, both yours and theres insurance company will probably settle for knock for knock which means they pay theres and yours pays yours. Either way you lose you no claims unfortunately.

u pulled out so its ur fault as u may have taken the other driver by suprise.but it is a tricky 1 coz he could have moved over and he shud have better reaction than that so god no's im just chattin for the sake ov it now hahahaha

they probably wont even look at it my mate crashed his mini it was insured as a 998 but was infact a 1380 they jus wrote it off (he brought it back off them after though).
