Under taking is not a criminal offence....its when you pull out again and cause other vehicles to sweve it becomes dangerous driving.

To undertake is against the highway code not the road traffic act

As regards "undertaking", a good prosecutor would ask you 1) What would happen if the other vehicle suddenly decided to return to a lane to its left whilst you were carrying out the manouvre?, and 2) What would happen if you attempted such a manouvre on a driving test? Case proved. People have been disqualified here where the manouvre has been caught on video, particularly where they have undertaken in the middle lane with a vehicle to each side of them.
