Theyre fuckin stupid cunts. Was this the morning after? How many times have we all driven the next day and probably been well over limit. Your mates just unlucky. Has he got a brief for when hes in court?

i thought that if the reading was substantionally different a second time it couldnt be used? could you not argue with innacuracy of the road side machine or something?

If your friend was 1mg over then they should have asked to have a blood sample taken. By the time a doctor has been called out your friends body would have processed the alcohol and your friend would have been let off.

he was pulled at roadside for a backlight out
breathlised and over by 1mg
taken 2 min down road to station and breathlised again stil 1mg over
booked in fingerprints ect
half hour goes by and they test again and now under limit so taken back to car

Yea it's annoying... I would have thought the Police advise you on stuff like that though, as it is in your rights as far as I know...

Brothers mate was three times over the limit...he dont rember getting into the car or anything just woke up in hospital....

he got £400 fine banned for two years and is still doing loads of community service. Was told he could of got up to 18 months in jail....he was lucky his deffence was shit hot.

I do not under any circumstances condone drink driving tis very bad

my mate got a year ban for drink driving and getting away from the cops, decided to give in though in the end, only got a yr and somehow got his license back

Fcuking stupid, if you know you are going to be having just 1 drink then why drive?

Sorry but people that drink and drive should be locked up and set on fire.

Right well fair enough mate. I bet a large amount of ppl have driven next day and still been over limit. alcohol taken 16hours to get out your system i think.

i would of thought he would get the minimum with 1mg over which is a 12 month ban, £100 fine and then if he does the hapas cours get 1/4 off which is 3 months so may do 9 months.

no points are dished out for drink driving even tho they state they are. they can be awarded if they feel like it.

blood test actualy shows more alchohol in the blood pe 100 ML then breath per 100 MG

Mate of mine got done three times over the limit got 18 month ban, or he could pay £300 and do some Drink driving Course and then it came down to 12 months. Basicly addmiting you have a dring prob even tho you dont then you get help and you can drive quicker

ban is mandatory 12 months, can be reduced by up to 30% with the awareness thing

Just a point to add though... Whatever happens, if you get arrested for anything then you should always seek legal advice before you do anything at the Police station. (I know this guy did wrong and all) I reckon he could have got off being banned if he had known about the blood test thing.
