Once they are invoiced they WILL notice and WILL contact you to get them collected. If you have sold them or fitted them you will have to pay so dont be stupid and try keep them.
Also whoever got your bilstein stuff and not their nice tein kit will be straight on the phone, so you wont just get to keep them.

unless the invoice etc says Bilstein and he got Tein.
The other customer will have an invoice saying tein and get bilstein so will phone and complain.
but as long as the invoice says bilstein they wont be able to prove it if he just says it was bilstein that arrived!

gona keep the starlet off the road for now so i dont have to fit them then send them beck etc give it a week and if im not contacted then what a deal try not break these ones

They can prove it through stock levels etc and will phone asking for it to be returned, if he says "oh no no I got bilstein" then they will either a) charge his car for the difference or b) use the small claims court or similar to get their money back. Companies arent stupid, its like when a website puts up a tv for £1.00 instead of £1000 and everyone on forums orders 10. They dont just send them out and go "ah well, woopsie".
Perhaps if the difference was was only 30-40 quid and a collection with a courier and to deliver the correct parts was going to cost say £20-30 then, yes I think they would let it slide... but for a good few hundred, I think not.

I personally wouldnt fit them or put them on ebay or whatever people are telling you to do as if it comes to it and they dempand payment, are you willing to fork out the extra dough? The only way is if you wait 3-4 months and THEN if nothing has come of it you might have got away with it.

end of the day, it was there fault not his, i would'nt be sending them back or paying extra money!

Its not a case of making you penis. Just in case something did go wrong with them he cant ring demontweeks as they will say we never sold you those, we sold you bla bla.. So by doing what I previously said, he has a cheap set of Tein Coilovers fully garanteed if anything goes wrong. No need for profit, just making sure he's sorted if things went wrong.

stick them on, jsut say you gave them to a mechanic to put them on before checking!!
its their fault for sending the wrong goods out, if they want them back then give then take them off and send them back used!!
their fault for not checking what they send out.

but they will aslo have to apy you money if they want them back as you will have to pay the mechanic to take them off

24. The Buyer is required to notify the company, in writing, of any shortage, misdelivery or other discrepancy immediately, or at the latest within seven days of such shortage, misdelivery or failure, thereafter the buyer shall be liable for any such discrepancy.

Exactly my point about selling them straight away. Then buy a real set of Tein Coilovers from them, that way you have the right suspension from them, with all the garantee and waranty

But you would still not have informed them about receiving the incorrect parts so you would be liable for the cost of the kit.
