I think all ISP's are duty bound to start tracking downloads as they can be fined if they dont start to try and stem the flow of illegal downloads.

They have given an ip address in the letter. they say that ... that IP was linked the the download

but that isnt our ip address

And I cant even find the 2 songs on my pc which they listed in the letter

It's fairly simple to get a new IP, all you need to do to get another IP is to restart your router, if you're using one.

virgin use dynamic IP so it will change when the modem is off or if the IP changes at set intervals. get into newsgroups

You are forgeting lease time. I've had my router off for 48 hours and can still get the same IP on restart. It depends on the ISP. They'll only issue another if the one you previously had has been taken in the time you've been off.
I'm sure they have a fair few spare so can be assigned the same one back quite often.

couldnt agree more, if i get a letter not that i would, i would get the full lot taken out broadband, HD box, second cable box, 2 telephone lines ect.

i got a letter back in september asking for 550 for downloading an album illegallly i had 30 days to pay needless to say i ignored the letter and have never had a follow up they threatend me saying i would be takin to court if i dont pay up

technically yes, but they're known as "sticky" ip addresses where, like allan said, lease times come into play and you could leave the modem off for days and still receive the same ip address.

How the hell can you justify that Virgin are in the wrong?! How will changing ISP help? You're downloading illegally, which is against T&Cs, just like it is with all ISPs.
And the letter is just a blanket letter, certainly nothing will come of it.

Either way, if you plan to download illegally then you should have some understanding of the different P2P networks and how insecure most of them are.
You certainly shouldn't be sharing files, nor downloading from P2P networks like Kazaa, Ares etc due to there being plenty of honey trap users. Likewise with Torrents, which can just be as bad. Stick to the SSL newsgroups or rapidshare, it costs but you're less likely to get caught and to be shafted with a huge bill.
And at the end of the day, you should be prepared to get shafted!

They can't snoop on your data, but they certainly have the rights to do what ever they want if they find you to be in breach of the T&Cs.

And just add, it's also probable that the letter was sent out in response to a third-party legal company getting in contact to alert the ISP that a user (mostly likely due to a honey trap on a P2P network) was found to be downloading illegally content.

It's not about illegal downloading, it's about privacy.

Most ISP's won't give up your details unless it's an absolute last resort.

Were virgin not interested in phorm as well, great ISP.
