Cakes can be small anyway.

Jaffa CAKES are made of sponge, fruit CAKE type things are made of sponge, hence they are legitimately named JAFFA CAKES

Jaffa Cakes are a cake.
The dictionary definition of a biscuit is a thin crisp cracker, or a cookie. Neither of which a Jaffa Cake is.
Incidentally, in 1991 McVities fought a successful legal battle with HM Customs and Excise over the classification of the product - in the UK, biscuits attract VAT where cakes do not.
If the manufactures say they're a cake and the courts say they're a cake, then for fuck sake fools - they're a cake.
