At the end of the day, it's just how you want to classify it - obviously it doesn't apply to every mp3! As mentioned, those freely available in the public domain aren't limited, but I'd assume most (but not all) people, when referring to mp3 downloads are thinking about getting them from P2P programs, and hence are probably ripped tunes anyway.

MP3 files do not need to be removed if they do not infringe any copyright. Stealing music is illegal. Storing music that you haven't stolen isn't.
The issue is of course, that MP3 collections tend not to be copyright free, and therefore anyone storing files in MP3 format tends to be infringing copyright for that reason.
Claiming MP3 is illegal is like claiming that audio tapes are, which of course they are not.
The whole 24 hour / 3 days thing is questionable also. Downloading copyright music is downloading copyright music. No timescale mentioned there. Bit of an urban myth that one.
