Then as scare tactics / to make money, they attempt to get money out of the person by sending a letter demanding £370 or whatever ... Then will follow this up with more and more letters warning of legal action etc, unless they pay up...
Of course, most people are scared so just pay up... It never goes to court to get contested.
... There are examples online where people just keep ignoring the letters forever and it never goes to trial. Eventually the company gives up trying.

for the record its not illegal to download material, its only illegal if you dont already own the material, my advice, go and buy the original, then say you downloaded it as a backup

It's not even legal to backup your own dvd's, or it wasn't, not looked at it for ages.

Yeah, so long as you have the cover for that CD then as said it was a backup.
As the real CD was scrached or something.
John,can you give details of the breach?
Other arguement is your wireless network got hacked and it was not you the downloaded.
There have been a few cases like that relating to pedo shit.

i got a letter first from Davenport Lyons over 2 years ago then a year later got one from ACS law i got my mums friend who is a charterd lawyer to write a nice friendly letter never heard from them since i still have the letter if your intrested?

A lad in work got a letter from Macmillan a few weeks back, well his dad did (account owner ) threatening all sorts and £370. He responded to the first letter with a templete letter of denial. Then they sent another 'template' not accepting his template and threatening 14 days or pending court action. That was about 3 weeks ago and he never responded to the second letter. Bunch of chancers tbh. There is a 203 page thread on the consumer action group forum with not a single person gone to court since Jan when the letter started . Tossers.
