I work for the Magistrates Courts mate, and your right, if your asking for all that information the CPS are likley to drop the case as they will have more important things to worry about, especially for £40 (I presume thats what it says they will ask for on the Summons??)

Police tried doing my dad the other months for doing 59 in a 30 zone in a 7.5 tonne lorry in the middle of London. He was adament he wasn't doing those speeds and contested it.
Turns out it was a car overtaking him that had set it off, he got a letter of apology.

JUst tell them you have no job and are claiming benefits, they will order it be paid at something daft like £5.00 per week for the next 200 years

Personally I think your doing the right thing. At the very least you'll get a reply of all the certificates and stuff, and if they do all come back ok, you'll have to try your best using the argument about being able to get inflated readings when being hand held, as the officers movement can influence the reading. Trying to prove that could be difficult though without getting hold of one, and all the guideline for use etc, and even then you'd have to argue the case that the officer moved.

If you could gte more details of the case that got thrown out on a similar matter it'd be helpful .

yeh im looking but is looking rather bleak. researched the magistrates near me and theyre very very pro police - middle class womens institute that kind of thing.

if they do have the documents i might be charged about 5k and disqualified.

which i dont have.

you openly admitted you were in the wrong and doing 45, but yet they said you were doing 50!

considering speedo inaccuacies over reading generally - you may of only been doing 42!

42 in a 30 is far less than a 50 in a 30.

42 in a 30 = sp 30, 3 points.

50 in a 30 = could be a small ban (6 points) due to first two years of driving.

I think it's right to contest it, as I think they need to sort out these guns properly as too many people are getting nicked at incorrect speeds.

IMHO you do's your crime, you take the punishment. The Police could look at this as you trying to be clever with them and come down harder (bigger fine etc) so it's a risky business. I'd personally take the 3 points.

for some reason the cto said that i'd get charged up to 5k for all the sources im asking for if i'm still convicted....


so now do i say guilty, then go on about circumstances, get say 4 points and a small fine,

or go ahead with my master plan lol

Appologise admit your wrong to speed, lick their arse and see where it takes you. Like I said, these letters are being sent ten a penny, and if it were me dealing with the case I'd slap a larger fine/points on for being a clever dick Upto you though!

You were speeding, take the punishment and get on with your life.

I have no problem when someone questions it when they havent been doing anything wrong, but questioning it and trying to get away with it is stupid and hope it backfires

80% of magistrates are dodery old people who don't really have a clue, the legal system is flawed to fuck low down.It's a load of bollox really.

my mate got caught doing 93 in a 60 got told he would get a summons fort he got off 6 months down the line it came through the post, he turned up at court and they a women said outside he was going to get a ban for sure, walks uinto court and the magistrait aplolgises for the CPS lack of evidnce and dropped the case, 6 monthsd is a long time for a summons they may have lost your documents, they are likly to be unable to provide you with the documents you request and you may get off, i think you should fight it
