It's likely timing out because everyone is downloading it. If you can access http://support.xbox.com/en-us/pages/xbox-360/how-to/update-xbox-360/system-updates.aspx then you can stick it on a USB stick and update the console that way.

prefer it to the old layout, however i cant seem to find where to download new demos and games etc

The new update has no added security, flashed consoles are still fine however future games (only fable 3 so far) will have ap25 checks to see if the game is legit. But theres already a new firmware coming that gets around it. Jtags are still the same, they get banned after not too long (as always) but all you do is flash a new kv to it and you can go online again. Im not for jtags for hacking, thats bullshit and ruins it for everyone else but they are good for getting dlc for nothing.
