I had the same in june, was hit by a pt cruiser that cut me up and sandwiched me between her and the kerb on the exit of a 3 lane round about. I was in a seperated lane with a huge white line divide (like arrow heads) she tried to switch from the middle lane to my lane and didnt look and hit the front drivers wing- suprisingly the only damage to my car was a scrape on the wheel arch and wing mirror and scuffs to my sofstars which took the brunt of the smash (and also churned up her side skirt) After about 3 days she ammitted liability to me and i thought everything was cool but now her insurers are trying to settle on 50/50! I thought this would be easy to prove(took photos of divide and scuffs on kerb+detailed diagram. but is getting really dragged out. The main reason the solicitor gave is that with a side on side impact there is no way of proving beyond reasonable doubt that either side is true. So the best thing is to get every single thing that might favour you and get your version of events set in stone from the outset. all unwanted hastle-careless bastidz

Good luck if your with flux mate.

When I came to renew my policy with them a couple of years ago they promptly informed me that it was going up due to an accident they had paid out for 3 months earlier which they had never even spoke to me about.
(although i had ran into the back of someone)
On contacting them they managed to give me three different dates for the "incident" none of which was in the same month the accident actuallu occured.

To sum up in my opinion flux are incompetent! but the best of luck to you!

Thay have been helpfull so far but they didnt ring me back yesterday


I have to contact them again today, lo and behold the last 2 days have been the busiest days at work in 6months and its the days i need to be on the phone not standing around selling fucking pykies cheap nokia phones on fucking payg

christ i'm getting annoyed reading this! this should be a open a shut case... she was plainly being a typical woman... no paying attension and drove into yer car! make sure your insurance company doesnt just payout and not tell you... find out were she lives and go around and boot her in the fanny!(you might end up jail though )

seriously though.... write everything down cos you will forget it... and draw diagrams of what happened from your point of view... and maybe seek some legal advise

tell her yes she can call you... be polite and professional... dont threaten her. shes going to ask you to pay for the damage without going through insurance i bet!

just tell her that you have you insurance company dealing with and that she should contact them.

She has hit you, end of story! May be a bit of a drag but I reckon you'll be ok! If she asks you to settle out of insurance now tell her to get to fcuk! Get to the hospital as well cos Im sure in one of your recent PM's you mentioned suffering from back and neck pain and was also very nervous about driving now!!!

Im now confused!

She said her "brother" estimated the work at £1k +

When i reckon its just a small lick of paint and pop a small dent out. If she is contacting me with a quote for say like £300 then why dont i pay it if she agrees to pay mine? I have a £500 excess on my insurance so if i made a claim id have to fork out that untill i got it back. so makes sense to just pay her off and leave my insurance and NCB alone? Plus itl be sorted quickly?

What do you think? remeber as open and shut as it may seem in a court of law i cant prove she hit me! So it may take months and get nasty.

my renewal is in jan i think so wouldnt it be better to just settle it?
