Not a chance.

In this situation, where he works on the phones and thats the main reason he was signed off, I see no reason why being at a pub would make any difference to be sat at home.

Now if they could prove he was sat there being loud, etc. for long periods then thats different.

Tribunals always tend to favour the employee and not the employer.

We've had people signed off with stress etc and they've been told by their GP to out.

Even though in some circumstances I do take the piss by using my illness as an excuse not to go to work, if I am off from work on the pretence that I'm suffering with my crohns I won't go down the pub for a pint or two or go in town shopping.

Not really on is it?

Thats obvious, being stuck in all day wouldn't do much good for someone stressed etc.

I agree with cosmo, you would get away with it, as said just because you are off because you are unable to do your job, doesn't mean your life should stop, if it was going out getting blasted then that would be daft, going out for one drink to see a friend, that's different.
End of the day you work to live, not live to work. The day that moto changes is the day you make a turn for the worse (exceptions apply obviously, if you love your job etc)

I've dealt with plenty of people like this, it's better to skin the cat another way, give them jobs they hate/cannot cope with, make them jump ship instead of you pushing them.

i done it last week.

was off wed thurs fri as my hay fever was really bad, couldnt open my right eye or stop sneezing but come 9 o'clock on friday I was ok so went out, threw the day sat and sunday I was really bad again, had docs on monday morning before work for some better medication. boss didnt mind that I was out when they found out

That's not the way to go about it, ownage is just an internet gigglebox.
I would sooner know 'person A' left from a job earning £2000 a month has now left to stack shelves in Asda for minimum wage.

Indeed.

Weve had one (Ive posted on here before about her) who was just taking the piss constantly. Got signed off a number of times due to 'stress' when we knew nothing was wrong with her.

She wanted us to sack her 100%, but we bided our time and did all we could to help her with her 'stress' and in the end she got that sick of us doing all we could that she walked out one day and never came back
