Retailers dont legally have to sell an item if it was priced wrong by mistake, they have clauses for this matter avaliable at their relavent head offices, i worked in retail for nearly 7 years and had instances where this was applied. Usually they will honour such a mistake to avoid the bad press/disattisfied customers

of course they wont send you they TV's for that pricec ... there is bound to be a clause in the T & C that states refunds will be given if a mistake/typo is made on a price.
Companies have to think and cover their arses against human error

04/03/2005 161 Dear Andrew Wojtulewicz
Thank you for contacting our Support Team. We believe that the price as previously shown was due to a pricing error on our website. As soon as we became aware of this error it was quickly rectified. As no order was placed, and no payment taken, we have not entered into any kind of legally binding contract, therefore we are not at liberty to provide this item at the incorrect price.
Kind Regards,
Jenni
Ebuyer Support
so im guessing if they have taken the order, they are legally binded rite?

Off Ebuyers T&C
quote:
3. Payment
3.1 Payment for the goods and delivery charges can be made by any method shown on the Suppliers website at the time you place your order. Payment shall be due before the delivery date and time for payment shall be a fundamental term of this agreement, breach of which shall entitle the Supplier to terminate the contract immediately.
If you have paid in FULL (ie money taken out from your account, you have entered into a legally binding contract with them, as they say.
Off Amazon
quote:
When We Charge Your Card
We do not charge your credit or debit card until we dispatch your order
If you have paid by cheque and we owe you a full or partial refund, we will send a refund cheque for the correct amount.
What we do about mispricings
Despite our best efforts, a small number of the more than 1.5 million items in our catalogue are mispriced. Rest assured, however, that we verify prices as part of our dispatch procedures.
If an item's correct price is lower than our stated price, we charge the lower amount and send you the item.
If a product's correct price is higher than our stated price, we will cancel your order and notify you of that cancellation.
Their clause (or T&C) say they only take money out or your account at the dispatch stage, therefore if Ebuyer abopted this clause, they have no right to sell the item at the wrong price.
Off Argos
quote:
2. Order process
2.2 The 'confirmation' stage sets out the final details of your order. Following this, we will send to you an order acknowledgement email detailing the products you have ordered. Please note that this email is not an order confirmation or order acceptance from Argos.
2.3 Acceptance of your order and the completion of the contract between you and us will take place on despatch to you of the products ordered unless we have notified you that we do not accept your order or you have cancelled it (please refer to Returns and refunds).
Argos say, Contract is made ONLY at the dispatch stage regardless of payment.
OFF EBUYER
quote:
1. Format of the Contract
1.1 These terms of sale apply to all goods supplied by Ebuyer (UK) Limited, whose registered office is at Woodbourne Road, Sheffield, S9 3LR, registered in England and Wales No. 3941136 (the Supplier).
1.2 No contract exists between you and the Supplier for the sale of any goods until the Supplier has received and accepted your order and the Supplier has received payment in full (in cleared funds). Once the Supplier does so, there is a binding legal contract between us.
1.3 By way of clarification, an acknowledgement of your order will be sent to you via e-mail when you place your order, but acceptance of your offer to buy the goods will not take place until after your payment is taken and you receive your acceptance e-mail. It is at this point that a binding legal contract is created and any contract is subject to these Terms and Conditions.
CONCLUSION.
SO what Ebuyer is saying = If you have recieved an email of confirmation AND payment is taken out, its a Legally binding contract (what is all the fuss about, swallow your pride, send the tv's out and rewrite your T&C!)
any one read the T&C?

no they dont at all, the price stickered in a store is an invitation to sale, they dont have to sell it at that price at all. if it is advertise to an exceptional portion of the population then they have to sell it at that price unless stipulated in TandC's
they can change to price (with agreement in TandCs) or rufuse the sale for whatever reason they want
