If you are getting a solicitor and are trying to get away with something in court do you tell the solictor bollox ie the story that you're gonna use or tell them the truth and let them bullshit their way thru court?

103 on duel carriageway. but trying unsure of driver etc, asked for a photo or video but neither were used, it was a hand held laser/radar gun and I never got pulled

just say you were driving but was sticking to the limit.

the fact they didnt chace you or pull you or have anything to pin this on you will just mean the judge will throw it out & not bother

well then yer trying to get off on a technicallity. id tell him the truth and see if he can apply the law.

well i know it works - i was got doing 106mph by a handheld, the cops were on the other side of the motorway on an embankment, had no video or photo evidence, and didnt chase or anything.

got letter through a week later, asked for evidence & they had none, so told em to go forth - few weeks later a summons arrived, so happily went to court on my own, they said your bein charged with speedin doin 106 on a motorway blah blah blah - asked them if I could see the evidence, cops said there wasnt any just the handheld which they had & quickly jotting down my numberplate... (the handheld doesn't store the speeds either, its just a readout, so again nothing really proving I was doing 106)

judge sniggered & said on grounds of lack of evidence there is nothing to do me with & dropped it - no charges, nothin!

PaulW is correct, yes the law has changed if they can prove that that particular car was doing 103 then they have a case, but if they have no photo evidence that that particular car, i.e. photo or video evidence was breaking the law, its your word against theres

So do I send the NIP back with my details and go to court and hope for lack of evidence or "do my best" to ascertain who the driver was but in the end not be able to?

u have the right of disclosure... they cant just produce the evidence in court u have to right to see it if they have it before hand.

Simply ring them and ask them the proceedure for getting the evidence they have about you particualr case. if they cannt produce this get a good solicitor and you will be in clear as your only following the law(kinda )

Oooook, just spoke to a solicitor and there is enough evidence believe it or not and i would liikely to be banned for a year or 6 months
