not always, sometimes they can be registered on behalf of someone else so the owners name isnt shown with a whois lookup.

The name that Nominet have is the legal owner. If they're registered by a company then the company owns it.
It would be lost in a dispute of course where the party with more legitimate claim would normally be awarded it.

my domains are in my name and i also have the nominet certifactes for each one, so if my host decide to be arses about it when i move, i dont have to worry about them keeping the domains!
