I was talking about a similar thing earlier, if you hadn't hit the brakes and the force of the impact shoved you into the car infront, who would be to blaim, you or the car that hit you?
This happened to me, except it was my fault. I hit the rear of 1 car i.e. the Fiesta in Fonz's case. Which then hit another car.
The car up front which only had rear damage, would claim off the one in the middle, who'd then claim for her damage plus the damage I made her cause to the other car.
Needless to say my renewal was ridiculous

well it comes as no surprise that the car is a write off.
they have offered me £3175 after i payed £3500 only tow months ago and paid £900 to have the head gasket replaced (a common known fault on the K series engine)
and i entitled to more?
i am kicking up a stink that the valuation maybe fair but for peace of mind i cant get the same car for that money (before purchasing i spent £130 on an AA inspection also) and thus any car i can afford with the settlement wont be of the same standard and give the same piece of mind

That means for your car to be repaired or replaced so it is of exactly the same quality as it was before the other party did you the damage

quality being the important word there...
can anyone offer some words of wisedom? they may give a "fair" price for the car but not for the quality....

NEVER accept the first offer. They will come back with a better offer.

gather some evidence to send off to them highlighting that if you want one in the condition that yours was you need more money
And that to spend what they are offering you for it you would end up with a far inferior vehicle.
take what they are offering as an interim payment and not full and final settlement. Make sure they know you are disputing it, then you can slog it out against each other for a few months.
