It will have been dropped, or lessoned to affray, due to the quality if the evidence on show. You can still "assault" someone and only get done for affray. That CCTV is pretty unclear, so the CPS will have decided to go for affray as you cant start a trail for Assault and then drop it mid trail to lesson the case, it would have just been trown out.

Thats what some lawyer fella told me at work today anyways.

I haven't seen much footage over and over, just the once, but what I have seen of it, I would have took all 5 of Gerrards clan apart in one swing, followed by a Scorpion style finishing move.

Affray's not a minor charge at all it still carries a 3 year maximum sentance. They've not charged Affray because they can't prove Gerrard hit the bloke they've charged it because so many people were involved they can't prove who caused what injury. Basically Affray is a public order offence and it takes into account the actions of a group of people as a collective.
