It can be dealt with in two ways

Section 5 of the public order act,(public place only) for the instance of issuing a penalty notice for disorder, or locking someone up on a friday night who has had to many beverages and is acting in a manner which is likely to cause harrassment, alarm or distress.

Common assault which falls under section 39 of the Criminal Justice Act 1988,
"do one" obviously not that wording, but Im sure you get my drift.

If it is caused either intentionally or recklessly, this is a point to be proven, under caution.

This can be just words, no physical element need be involved.

Offence wording for section 39;

It is committed by a person who causes another person to apprehend the immediate use of unlawful violence.

So "fudge off" in an agressive manner can be taken as section 39.

I was attacked and defended myself, he had witnesses lie and I think it was known by just about everyone they were full of shit.
Was also first time I had been in trouble except for someone trying to get me done for assault when I was 14 again self defense.

it's a sad state of affairs, but it's what the CPS will run with. I've had this a few times where someone has been arrested for a section 20 or section 47, and cps has dropped the charge to 47 or 39 as the defendant will pleade guilty to the lesser charge.

They probably wasted time doing a guy making phonecalls while there was a group of 20 properly assaulting a guy right under their noses.

This lad (Who i've known for 6 years approx) was being highly racist towards my best mate. He found out and so we set upon him in a bar after 2 weeks of it happening. Gave him a couple off uppercuts while my mate was punching him also. Put him in hosp for 2 days.

Totally out of charature for me.



Pushnishment:

100hrs Community serv.
18 month susp sentance (6months)
£250 Costs.
Electronic tag for 3 months (Feb, March / Apr 2009)

*So 9pm -> 7am I had to be in my 4 walls of my house otherwise i'd be off to see uncle bungle in the showers... soap on a rope etc etc...

the best thing to do is phone up matey.

I am awaiting results for my testing to join RAF so i would recommending it


What do you want to do?
Do you have a trade?
Are you looking for a trade?
Are you fit?
Can you run a mile and a half in 12 mins?

some things may sound silly but...
All these are questions you have to answer or be fit for.
