NTL/Telewest (aka Virgin Media) crack down has been going on for the last 3/4 years and they've apparently been using 'deep packet inspection' for the last 2/3 years. Letters do get sent out, just head over to cableforum.co.uk and there are a handful of people (tend to be people download 200GB+) that have received them but nothing seems to get done about it.
To be honest, as long as you aren't taking the piss and downloading 100's of GBs a month then i wouldn't worry about. And if you are worried about it then get yourself a SSL newgroup provider....
