First port of call would be to find out who owns the strip of land. My parents had to build their front wall 1m from the road and it's grey as to whether they own it or the council. We maintain it and have levelled and gravelled it but when we put a series of walling stones on it to stop people parking on it, we were told we had to remove them as it fell within the road boundary; we haven't and nothing's ever been said but I'd guess if anything happened and someone comained then it could come back on us as we were officially told to remove them. Our's aren't immediately on the road side like the ones in the photos here though, they're set back 6/7".

Depends if the pothole is visible or not, pothole might also not have been there the last time you were at that road.

Id go back and night and rip them stones up. Hate people who do things like that. Woman did it locally with railway sleepers. They soon disappeared.

If it was painted white and not sticking in the road then fair play. Actually spoke to a neighbour on the road and a police car chased a van down there a few years ago and did the same thing, and the people were told to remove them. So will see what happens.

at comparing potholes (generally found randomly positioned on a road) with a large stone that is right on the boundary/edge of the road...

Hitting a kerb is different to hitting a stone wall thats in the road.

Pothole can be in middle of road and easily obscured, especially if dark and wet. If you hit a big obvious one then yes, same applies.
