If it fails you can't drive it anyway.

At our garage we don't do MOT's but if you brought it to us we check it round, take it to the test station and bring it back. Basically its pretty much guaranteed to get an MOT in the day unless something major is wrong.
What car is it? Age?

To be fair unless its rotten or just completely not road worthy they cant stop you driving it away, its still got mot.
If you took it somewhere to check it over they would charge you unless you know someone.
You could do a quick check yourself on certain things

Ok joe fair play
Not worked like that for me in the past, although the rules may have been bent slightly for me as i know the guy.
Mine failed emisions on a saxo and i went back everyday for a week till it passed as he never did me a failiure certificate

Do you have anything to back that statement up?
As far as I am aware the Mot is purely a test done on one day and clearly states that the car is upto standard on that day but does not mean it will be for the next year.
If your car fails its test a week before the old Mot runs out it will still have an Mot however it could be deemed unsafe to be on the road.
It would still have a valid Mot certificate, so I do not see how you could be prosecuted for no Mot!

I had my car mot'd about 10 days before the due date, it failed on excessive wear to the brake discs I had it retested 9 days later which it then passed but does this mean i was driving my car with no MOT

I think ur alright cus like i said mine failed and i was still driving it for over a week. I always thought that ur MOT can only run out on the date it expires. Mine expired June 12th but it passed on the 11th but the date of expiry is still june 12th 2008

A fail over rides an MOT certificate (wether it is still in date or not)
I know mine just failed - I had 2 weeks left on old MOT certificate and the garage retains the old one

I never gave them my old mot certificate so i still had a valid one even though it failed!

If you've got the certificate then you've still got mot.
i think its garage dependant, some of them are to the book kind of twats and others are just human

No you did'nt as the fail will have been logged down on computer, they dont need to see a piece of paper anymore really can just look it up.

if u go for the test upto 30 days before hand, and it passes, then u can have it forward dated to the expiry date. thats why you see some cars avertised with 13 months MOT.
even if it fails in this time, your old one will still cover you.
