are the stairs legal open on one side; I would have thought building regulations meant that you need to prevent people from falling off?

I know but have you checked with Building Regs?
You may find that the buyer's survey throws it up as an issue - might be cheaper to do it now, rather than try to argue on price a sale time?

Really have no idea, think my dad would of checked.
Quite easy just to stick a rail there though.

well thats a conspiracy about the stairs as my mum and dad have recently moved and there stairs were very similar just had a backing on each step and no probs with surveys or anything ??

Stairs will be fine, they're like that in every house which is ever on Grand Designs with no problems.

Were not talking about the treads, its the lack of handrail.

exactly as sidibbons says as when you have ballastrades the regs state that there must be no more then 100mm spacing so a babys head can not fit through them so no hand rail at all will not pass building regs.

They probably dont, it only becomes a problem when you come to sell the house
