The Lack of Auto Focus on most lenses is pissing me off on the D40

It depends if you think you can make use of what extra it gives you really. Compare the 2 products side by side and look at the advantages.

The D70s would be a nicer option.
The only big advantage I can see is that most lenses will AF on the D70, but the JPEGs from the D70 will need more work than the ones from the D40.
For me personally I would never buy an older model, the D90 or D300 would be the only way to go.

D90 would be my choice aswell. It looks really good!
Although I wouldnt mind a D3

Although if I was upgrading I would consider going full frame.
But thats not a cheap upgrade route
