if it is found that someone does not pay income tax, is it the employer or employees resposibability or both?
what are the punishements to both parties?

I reckon the employer, but it would probably be your duty to inform your employer of any mistake.
Not sure about the punishment, but you never want to fuck over the tax man

Not sure. Your employer should be responsible for making the deductions on your behalf, but any reasonable person should expect to pay something anyway - I suspect both are liable.

If you are on the PAYE system (BACS etc) the employer is responsible for holding back 20% (or 40%) of your income for Income Tax and 11% for National Insurance. If it has not been paid the tax man will chase your employer (think they get all sorts of fines). Your employer will then take it off you in another month, so if I were you I would scurry away the extra you receive ready to supplement your income in the future when they eventually catch up with you (and they will )

Similarly, if you're self-employed, it is your problem.
