A month ago now i went to get new front tyres fitted at a local tyre company. They fitted them but forgot to torque the front left wheel, and low and behold the front left btyre fell off my car while i was driving along and did about 2 grands worth of damage to my car.
I got the company to admit liability and got the car into the workshop. They have now had it for just over a month, they said it would take a week originally. Basically they needed to fit a new side wing, wheel arch, side skirt, fix suspension and a new front bumper from PSG.
They were sent the bumper by PSG and they found that it doesn't just go straight on. Nooo SH*T. I could have told them that. Problem is, they didn't find this out until they had fitted it already. The bumper on either side doesn't line up with the wheelarches, it needs modifying,well blow me!! who would have thought it.
I told the bodyshop that this wasn't good enough and that modifying the bumper is part and parcel with fitting it, otherwise it wont fit. They then told me that i would have to get an assessor to look at the car and authorise the further work, so I did.
The assessor has said that because the bumper is not a standard vauxhall part they cannot be held responsible for the porr marketing of the product and that i will just have to cope with it or pay for it myself.
Personally i dont see why i should have to pay for anything. The point of having an insurance company is so you can restore ur car to its original state before an accident is it not. Why should i be left out of pocket due to a companies gross negligence. I have to give CIS call tomorrow and have it out with them. The company that caused all these problems arent being very helpful considering they could have killed me!!
Anyway, they will basically have to smooth the bumper into the wheelarches to make it look respectable but theya rent willing to pay for it.
What are everyones opinions on this matter?? as many as possible please. sorry for the book.

Then why didn't you??? If they are not a recognised modding bodyshop then how are they meant to know that it's not meant to fit?

yes but it was not his fault. it was the place that fitted the wheels. therefore they have to repair the car to the spec it was

exactly vibs, ur good at this aren't u mate. I dont know why they aren't being more helpful to be honest. I could crucify them if i wanted, in the courts and run there company name through the ground!

yep, all mods declared and insured. Its going through my insurance first and then the tyre companies. My insurance are the one that said they wont do it and they arent even the ones that will end up paying for it, its no skin off their nose.

Do u think it should be the bodyshop that pays for the extra modifying cos they didn't prep the bumper properly or the insurance company??

erm no they dont, if u disclose your modifications then they replace em, i rang cis and liverpool victoris today for quotes and asked them this specifically.

If the car was damaged in their premises, I don't see why your insurance should even have to be involved. Even if the claim is later settled by the other partys insurance, your insurance company will often take it into account come renewal time.
The fact that the bumper needs tweeking to fit isn't your problem, but maybe a bodyshop with experience of fitting fibreglass kits should have been chosen. Minor mods are needed to get the bumper to fit nicely, but it shouldn't need anything as drastic as smoothing into wheel arches.
I had a similar situation (much worse though) happen to my Corsa when some work was being done, and I had £2000 of work paid for by their insurance without having to involve mine at all.

If you damaged the car and it was your fault then your insurance would only normally return to original, not to moddified even if declared, some still return to modded though.
But seen as it was there fault they HAVE TO by law return the car to the state it was in before the accident, that means they HAVE TO make the car look exactly how it was, and if that means modding the bumper and such then thats what they will have to do.

They'll need to spend a bit more and refer the job on to a bodyshop with more experience in aftermarket parts.

If they are causing trouble jst threaten them with the papers, or even legal action as their incompitence could have cost you your life. They should be more than willing to keep you quiet and if they're not then make them swett a bit!!
