Basically, I was involved in a smash, the driver went into the side of me, his fault. I got a pic of his car & reg. He then left the scene, I Reported strait to the police & 10 months later (takes the piss) I recieve a letter saying he is going to be summonsed to court, charged with driving without due care, Leaving the scene of an accident & failing to report the accident.

Just wandering what happens now? will i get a payout ?

Car is all fixed btw.

i dont see why not if hes found guilty theres no reason you shouldnt get compo

hmm, he should have to pay for the repairs that i made to the car i would have thought. i might need some recipts though

no. if someone hits you and wether its your fault or not you inform your insurance, in this case with it being the other drivers fault you should of given them the car details and they would have repaired the car and paid compensation if warrented

because i didn't want my insurance going up, and i thought i'd be able to claim money back with the recipts

But it wasnt a fault claim so your insurance wont be going up. The money to fix your car would have come from his insurance not yours.

As we've discovered on here in the past few weeks though: Even if its a non-fault accident, unless you change insurance, the chances are, your own insurance will also go up. I dont know why this happens, its very unfair, but it seems to be the way...

you told your insurance you were in a crash so you'l still get shafted if your with a crap insurance company so may aswell claimed

I would guess you need to sue him for the money. It is entirely possible to do it but not something I would fancy taking on without legal advice. If you've got legal cover on your insurance policy I would be seeing if they'll take it on. Even if not they may still have an interest in it.

If the other driver is insured and at fault then there should be no reason why you should be out of pocket. Just might take some legal clout on your behalf to recover it.

i had this happen, repaired it straight away. the police sorted it out and his insurance contacted me within two weeks, i sent them the bill and was paid in a month
