Afternoon All,

I was caught speeding doing 40 in a 30 on the 9th November, I have been issued the letter today dated 9/04/11.

Can I ignore it or is it still within their period they are allowed to post me it?

was it the 1st letter, notice of intended prosecution, they have to issue that in 14days or at the event, then they have 6months i think

i am fairly certain its over the limit now, but id imagine if they took you to court you would still get the points etc .

Under UK law they have 14 days to notify you (NIP) of any alleged offence - however, there are certain "opt outs". If you were driving a hire car, or a car not registered in your name this deadline doesnt apply.

It also doesnt apply if there is any other reason why it took longer than 14 days, such as you recently bought the vehicle or you changed address (and the DVLA database wasnt correct).

If it's their laziness or negligence then the charge will not stick (although you should still complete the s172 request else you will be prosecuted for failing to furnish)

I'd owned the car for about 9 months previosu, which I have now actually sold and not moved for around 11 years

Its the first letter when they want me to accept.

My dad got caught doing 97 in a 70 and it took them 8 months to send the letter and he ignored it, then police came to his door with the piture from the camera and my dad said yes that is me and that was 4 years ago and has not heard anything back from them. so just ignore it.

So it is the letter where they ask you to sign it etc and give your details? Ie; the Notice of Intended Prosecution? It'll be thrown out now if they try to persue it!

i would take the advice of whats posted on here as a guideline only, its very easy for people not at risk of prosecution to say ignore it/throw it away/fire bomb the police station etc.

Solicitors are shit. I asked one whether or not I should sue the council over a pothole and he said no.

I did anyway and won.

Just ask on pepipoo first. They know their shit
