Long and short of the story is my mums car got driven into yesterday, she rang her insurance to make a claim but they told her the policy hadn't renewed and she wasn't insured at the time. the other woman has admitted liability but wants her car fixing through my mums insurance....which obviously would/couldn't happen. It's my mums own stupid fault for not checking but where does she stand on the matter?

go with her to an accident repair shop and find out how much £££ it'll be to fix it and pay it out rite

ermm you need to get it fixed asap. Your mum is going to get shafted 6points + fine if her insurance/police find out and you were involved in a crash all the repair and injury claims will be done out of her pocket.

so get it sorted asap!

she rang the insurance and told them what had happened...they said they were liable to inform the police of the offence. I cant see them doing this in all honesty

Why does she want it fixed through your mums insurance if she's admitted liability?

You mum is stuck though, I can imagine it could get bad for her if she doesn't pay up.

the other woman this is...my mum is obviously retarded for not checking. told her she's lucky she didn't run up the arse end of a new car tbh

Your mums not insured so the other party will need to go through their insurance.

Your mum will get 6 points and prob £100 fine if she's got a clean licence

Tell her its her fault and she's paying for all of it via her insurer.

The fact your mum wasn't insured doesn't preclude your ability to make a claim against the other driver.

The fact she was uninsured on the highway is a matter for the Police who may choose to pursue it as a separate issue, she might just have to take that on the chin if it comes up. No bearing on the repair though if you have an admission of liability.

Phone womans insurance and start a claim.

Get mums car insured right now.

Hope it doesn't come up, be prepared for it to anyway.

Out of interest when did it run out and how often does tour mum drive the car? Seems funny she didn't get picked up by an anpr as most traffic cars have them now

can I ask, does it not stipulate on a policy that they will automatically renew from the previous bank for policies? why was the insurance not renewed?

i know but might be worth checking? if the money was in the account and it says on the policy it will automatically renew surely the insurance company can be held liable for that error or you could try and force that?

That wouldn't form any sort of defence against the conviction, but it may help convince them to act on your behalf. I wouldn't want to rely on that too strongly though, it's hardly their obligation.

Get the car insured & ring the other woman's insurance. It doesn't matter if your mum isn't insured from a claiming point of view but the Police may have something to say if they found out
