Right need bit of peoples experiences/advice.

Missus just rang me (im away working) that shes gone into the back of someone ...I thought the dreaded blame scenario but...

Basically the actions of one driver(A) by not getting into correct lane or over stepping the white line basically made a driver(B) slam on the brakes to avoid her which resulted in my missus having no option but to crash into driver B.

She has 2 witnesses one is driver B and a member of the public (details taken) driver A drove off totally unaware of the accident she caused.

Brief explanation but it sums it up basically.

Police informed and reg of driver A taken.

Our car is pretty bad front passenger side mashed in no damage to driver B (had crash bars on)

Not really drive A's fault.

Your missus and driver B's insurance will argue it out, ultimately blaming your missus.

If she couldn't brake in time she was too close.

Pretty sure your Mrs will still have to take the blame as they will argue she didn't leave enough stopping distance between her car and the car in front.

Cant see her winning this. 50/50 at best but will the driver in front settle for that? Probably not.

insurance will just say she wasnt leaving enough space from the person in front, making her at fault

I hit the back of someone about 10 years ago. Went 50/50 as the driver in front crashed first...... so not always completely cut and dry.

I ran into the back of a stupid woman last Thurs. I was behind her approaching a wide open T juncion, loads of vision both ways as you approach, she slowed and then pulled out but as she crossed the white line she slammed on for no reason. I had nowhere to go in wet conditions and went into back of her. I've not admitted fault but probs will get blamed as with 95% of cases if you run into someone from behind.

Although morally it's not your fault and I hate when people do that, it is your fault.

Wet conditions mean you should be even further back/more vigilant.

You hit someone from behind its your fault, whatever the scenario.

There was a tv show about paki's that go round slamming on at junctions so they get hit from behind to get compo.

If she's gone into the back of someone it'll be very hard to prove it wasnt her fault only you've got some pretty good witnesses or other evidence.

You're right in your first point, but if you can show the car infront did it deliberately to cause the accident they're at fault. If they have a history of it, or in one case I dealt with a witness comes forward then they'll be found liable.

But in a genuine scenario I'm afraid it's your girlfriends fault for not leaving a breaking distance, as far as liability for the crash is concerned.
Unless there's fraud involved or the driver of the car she hit accepts some liability she wil

if there is no damage to car b then why are you giong through insurance? unless they want to claim something for personal injury?

I've just had my claim settled 50/50 at court for some dick pulling out of a junction without looking and going straight into the side of me. Bunch of idiots.

Claimed that i was speeding and hidden from view, 2 lane road, left lane was stationery, mine was clear.

He got a mate to lie and say that i was speeding, which i wasnt.
Complicated load of crap that took 2 YEARS to sort out

speeding wouldn't stand up in court if there wasn't any evidence of you doing so.
