Before I file a conflict/resolution thing.... bought a t-shirt from the US, item turned up as the worng one, seller offered me piffly $5 refund to keep... I said not itnerested, want to return and expect original P&P fees, my P&P fees and the ridiculious £12 customs fees I had to pay all refunded, on the absis that it was his error... is this fair? He has so far only offered to refund the original selling price and now isnt replying...

I think that's fair. You've paid for something you haven't received so you are entitled to all your money back.

You'd only recieve fees eBay/Paypal can see you've paid.
Possibly the payment for postage back if its in his returns section. You wont get customs money back 100%.

If its a decent seller, and you have proof of the customs paid, they'd pay it.
If not, they don't have to. Only what eBay see you've paid through paypal, would be the disputed money and if their returns policy states they'll refund postage on goods sent on error, then that too.

What Whittie says is 100% correct.
If you file a dispute, you'll get back what you paid including your postage but will have to proove to PayPal you have returned the item. Unlikely you'll get return postage back and definately will not get customs fees back.

Seems ridic to me (as per usual with eBay) but cheers for the clarification chaps.
Pissed off with the seller for not marking it as a gift ina plain enevelope in the first place tbh and did complain to him about it at the time but hey ho
Unfortunately I paid cash for the customs fee and no receipt :/

if its marked as a gift theyre not insured, and if it went missing you'd complain that they wouldnt give you a new one for free.
with no proof of customs fee, it wont be refunded. probably wouldnt be anyway because thats a cost youve incurred yourself, not one the seller or ebay has applied

Most of my sales are from oversea's I'll always mark as gift and minimal value but this is more me doing my buyers a favour and for an easy life as if they're not 100% happy with the item it's just another reason for them to complain.
If I was selling hundreds of items and doing in properly I would be marking it all up correctly for sure. It's not my concern at the end of the day what the buyer pays for duty, they accept that responsibilty when buying the item.
If the sellers being funny about it then just open a dispute, PayPal might not even ask you to return the item. Be prepared to wait a while though as you'll instantly piss them off when the dispute is opened.

How can you possible complain about him not fiddling the customs?
If he does it - sound - but that is no grounds at all to be pissed off.
You'll also only get the money if something goes back overseas as posted, at your expense.
I'd have him send you the right one at a bit of a discount and sell that one on.
That's probably what I would offer if I was selling it as well, certainly wouldn't get involved trying to sort out someone who was complaining about a shop actually doing what they're legally required to do.

You will receive full refund item price and P&P then eBay won't make you send it back.

I don't think DSRs apply as the seller is based in the USA.
Customs fees you should get back if you request it from HMRC as the item is going back to the country of origin.

To be clear, what he sent me is hideous and i very much doubt he ever had what he was advertising but hey ho. he replied last night saying he will refund me price paid but not p&p or customs so i'll be filing a dispute as im not paying return p&p for an item he wrongly posted to me
