Basically about 2 weeks ago i was on my way to work. someone cut me up on a road approaching a roundabout, i was in left hand lane he was in right but cut half into my lane just as we were about to go round. it was raining and i was doing about 20 he was doin about 10. i skidded and hit his near side rear quarter. wasn't a hard smash so not alot of damage. i got a slight dent and scratch to the corner of my bumper and from the looks of it he had nothin. we swapped names and addresses as it seemed like the rite thing to do. but seeing as the damage on my car wasn't bad im not goin through insurance. car goes in on monday and i'll have it back on wednesday. i presumed he wasn't going to claim but received a letter today stating he is, and seeing as it was not my fault i aint paying a penny to him so what im goin to tell insurance is i briefly touched him and just got a scratch which polished out therefore not causing enough damage for him to claim. if they need to see my car it will be fixed. can he still claim even if there is no damge to my car?? btw he can't prove my car was damaged as he didn't take pics. can i get away with it??
sorry its an essay just want some advice

if it is his fault then there is not a problem. as he is has put a claim in he maybe be trying to say it is your fault however if he cut into your lane then it is his fault. you can either ignore the letter or inform your insuarnce company. what did his letter actually say

best to draw a little diagram of what happened, making sure the road lines are clearly marked and where his car was at point of impact, i assume he was crossing over into your lane...

were you undertaking him?

i skidded and hit his near side rear quarter.

if this the case the areas of damage prove he was in wrong. why he on your right when u in left lane? if he coming in ur lane he shouldnt be by side. shud be behind. claim off his insurance for summat

The letter says:
We have been contacted by MORE TH>N, alleging that your vehicle was involved in an incident on 17 February 2004.

As we have been unable to contact you please telephone us on the number below to discuss the matter further.

We look forward to hearing from you.

Please note:

Your policy requires you to report all incidents, which may result in a claim, as soon as reasonably possible.

Yours sincerely bla bla

I wouldn't say i was undertaking because if he hadnt of cut me up we would both been level going along.

yeah seems to me that he was in the wrong

tell em that the damage wsa so little you just polished out and didn't think other party was going to bother with insurance due to the lack of n e damage

mention that " he didn't see me" incompotence on the other parties behalf should help you out

ohh yes.
i work for churchill insurance company claims dept!
unless you have an indepedent witness/or can prove you were no where in the area at that time! ;-) im afraid the accident would be classed as a hit in the rear!!!
you could maybe swing a 50/50 but say good by to your no claims discount!!

there not called "no BLAME discount!"

but what if there isnt substantial damage to my car to cause that amount of damage. whats to say he didn't reverse into a post?

at the end of the day its all about proving that it was you!!!
unless he has a witness or a statement from yoursel saying that you where their wots to say you were not at your girlfriends house having dinner with her family?! no damage to your car!!! he could have just got your reg mixed up with a similar one !!

looking at that he was already infront so high way code states you should be traveling at a resonable stopping distance!!!
wot if a kid run across round about and infront slammed on brakes etc

did he indicate? coz if he says he did youve gotta prove he didnt and thats where the safe distance rule comes in! hit in rear is always a fault!
if some one wanted to be a c.u.n.t they could be driving along pull up hanbrake and if someone its em in rear the other driver is at fault

hehe had to be done, its just a diagram showing what i hate about other drivers, twats cutting into ur lane on roundabouts when ur driving round on the inside lane

aye that rule in the back is gay as my mate was waiting at a small junction and a bloke had some rear end damage so at the junction they were happily waiting then the geezer suddenly reversed trying to simulate a rear bump by my friend to claim luckly he was paying attention and quickly got out of there! stupid rule in my books!

similar thing happened to me about a year ago, two lanes at roundabout, left lane straight on right lane rightonly, the twat in the right lane at the side of me decided to go straight on, clipped my front bumper with his rear 3/4. he tried blaming that on me. ins comp went 50/50 then 3 months later paid out saying it was his fault and not mine
