They have changed the website completely now checked before see if it still worked. I doubt it we will recieve phones as the e-mails says they are out of stock but i suppose they will have to do something as we legitametly ordered the phones for nothing according to there website,,, Has anyone actually received the phone yet mine was due to arrive to until i got the email

There is no way it was a scam to collect data - o2 would be in line to be sued if that were the case.
Just a simple error on their website, be interesting to see if phones start to turn up if/when back in stock.
Pretty sure the law states the consumer is doing nothing wrong in this case, a bug on their website is their fault and IIRC they should honour the deal.

Most companies have the right to refuse to sell u anything they want, for example if an item was marked up as 1p they normally have a clause saying they dont "have" to sell it for that price

In this case o2 would have to deliver the phones as the transaction has been completed. If the transaction had not been completed they would be able to refuse. So phones MUST be delievered .
Edit - Or its onto the phone with trading standards and a much more heafty bill for O2 methinks

contract law would not force 02 to sell these phones and it DEFFO was not a marketing scam... just a cock up... but they would not be forced to sell anything on... esp considering they received noi money for the phones

Like what happened with an airline today, they accidentally put up free flights, so 100's of people are now getting free flights as thats what they advertised. Same with these phones.
