Not a legal procedure I might add....

Have confirmed with Consumer Direct that the responsibilty for the console is with Argos within the 12 month period as they have sold a product that is not fit for purpose.

Look at this page:

This point in particular:

The trader must sort out your problem, not the manufacturer
Remember, if you are entitled to a refund, replacement, repair or compensation, it is the trader who must sort out your problem. The trader cannot tell you to go back to the manufacturer.

Doesnt mean that at all

They either have to:

A: Replace the console

B: Manage the repair themselves - meaning calling them up, having it picked up and redelivered there ect... within a specified period.

What that says is basically the trader has to repair it for you, which as matt says means them phoning ms instead of you.

Whether they would replace it instead of going to the hassle or not is a different matter.

From my reading it certainly does not say take it back and get a refund or replacement because it crashes.

A crash is a fault. 3 red lights is a fault.

Its a common problem...... Microsoft have acknowledged this.

I must be as well.

I'm not disputing the 360 has a fault, I would say about 40% of them have a fault.

You just have to grin and bear it like everybody else though.

Unless argos or whoever are feeling nice and give you a refund/replacement, that link says nothing about them legally doing it.

Surely you shouldnt have to though, as if you cant use the item for its intended use (i.e. more than 10mins of gmaeplay before it fucks up) then surely it should be fixed/replaced.

ring up argos ask for the manager of the depot, and tell them your issue and what consumer direct says and if tey dont do anything ring trading standards and argos would have visit from them.

lol what a load of tish, if it has a fault weather intermitent or not they should have it fixed for you, its not fit for purpose.

argos should have arranged the repair for you, regardless of a permanent red light or not lol.

people dont have to grin and bare it lol for some one who comes across as intelligent in some posts you lost the ball on this one.

imagine if you had a fault with a mobile, i.e would only make 1 out of 3 calls but when you went you couldnt prove it, would you be happy just grinning and bearing it till it totally wouldnt turn on.

not to mention im pretty sure microsoft have more diagnostic tools than "does it have 3 red lights", if it is sent i would guess they would be more indepth than checking if it had 3 red lights or not lol.

im also talking from experience, ive had a console repaired through gamestation for a faulty dvd drive which was intermitent.

i also used to work in a store that repaired/replaces consoles for intermitent faults and not just 3 red lights.

not to mention i work in asda now and we would replace it without hassel at all.

I rang Cwmbran and they said you have to ring Microsoft to get them to do the diagnostics then microsoft arrange for a courier to come and get it to be fixed

No.

I rang them, told them the fault, and the manager guy said, 'yeah no worries, bring it along wth the reciept, and we'll swap hard drives and give you a brand new one.'

Even got fresh batteries inside
