You can carry a spare which is bald, just as you are allowed to carry blad tyres around in your car, they can't do you for that. If you fit it, then thats obviously an offence, as mentioned. It was not required for the Mot to have a spare, but a below legal tread depth spare used to be an offence if intended to be used as a spare. Like the keys in the ignition think if you are pissed in your car....intent to drive.
What is an offence and nobody has mentioned is, if you have to stop due to a puncture and you cause traffic build up or an accident, and you did not have a spare you can be prosecuted. Carrying foam like in the Elises counts as an alternative to a spare. So if you get a flat when they reduce the motorway to one lane like they do when they fix it, then you can get done for not having a means to make your vehicle mobile again.

No-one ever listens when people say, that it doesn't matter what condition you're spare tyre is in for the mot. you can have a flat tyre with all the cords showing, and you'd still pass IT IS NOT A CASE OF IF ITS THERE ITS GOTTA BE LEGAL!!!!!!!! If you belive this, then you are wrong, because following this logic, then a space saver is illegal, as it is of a different size to the rest of you're wheels (because wheels on the same axel must be the same size)
The only thing that has got to work if its there is front fogs............
Btw, i test cars for MOT's, so i am not wrong!!

Front fogs don't come into mot in the same way as nearside rear fog doesnt.
They are an accessory.
