So got a letter in December from Virgin Media advising that my service will increase by £5.00 per month and not happy about this so want to cancel my package. Called today and they said this would be a cost of £49 if I want to do this however have been told I can get this fee waivered due to a breach of contract in putting the price up?
Also the same with my mobile phone contract.
Is this correct? anyone done this?

Iirc if it's more than the increase in rpi, you can cancel.
may be talking crap, but seen it mentioned on a website when looking for the same advice as you.
5 quid will no doubt be more, so reasonable grounds to cancel.

Also depends on the original price of your package when you took it out. VM wont put the price up to more than allowed or else everyone would cancel. No doubt within there rights. read the small print.

Yup that did happen. It was mostly aimed at mobile contracts but guess it would cover these.
The funny thing is after all the hassle of putting the rules in place the operators have already got out of it by specifically saying the price WILL go up by at least the rate of inflation. Then they are fully within their rights to put the price up each year now (this is on all new contracts)

Don't think that's actually come in yet
Got an e-mail that my O2 contract is going up in March and sure I read somewhere they were doing it before the legislation starts

I'm pretty sure the new rules only apply on new contracts so existing ones will not be affected.

It was a big thing at the time, loads of people did it. I got to keep my phone and cancel the contract only a couple of months in. I forget what it was all about tho.

I got the same letter, though a quick call asking to cancel and they reduced the price by £14 a month, upgraded the broadband (free install) and £30 credit.

It'll be watertight in the Terms and Conditions (for now anyway) that they reserve the right to price increases.

new legislation that came in is only if you take out a contract from now on , it don't work on contracts that were all ready in place before new rules came out, as far as im led to believe

from what I remember when I was with orange, provided you had only just taken the contract out (think it was 2months) then you could cancel for free other than that as Hammer said it will be in the contract that they can change price.
Surely it is cheaper to stay in the contract until its up than pay the £50 (I assume its a 12 month contract + already a few months in)

I would've thought best option was to sell the phone, assuming it's decent, then use cash to pay outstanding.
