My HTC one x is 3 months old.

Its faulty, been off for repair, came back still the same.

I kicked off and complained and they said they can only give me a recon phone which comes with 3 month warranty! My phone is only 3 months old and im in a 24 month contract.

Ive told them i want to cancel my contract and they want to charge me £650!

Help... can i do anything or am i fucked?

I'd be asking what exactly the £650 includes because it certainly isn't for a faulty phone

Get on to CAB and see what they say but it's clear the product isn't fit for purpose (SOGA i believe) so i would start going down that route.

Make sure you're doing the obvious and note down times/dates and names of everyone you speak/have spoken to and try and escalate it to managers. Also make sure you have a clear objective, be that cancel the contract or a new phone.
And don't cancel your direct debit what ever you do as that'll land you a load of hot water.

£650 is the remaining monthly rentals ETC ETC they said.

Gonna keep arguing. Just got a call from the complaints manager and they said once its older than 30 days they can not replace with new only recon. There is no way round it.

It got sent off for GPS signal not locking... all they did was update the software apparently(which the didnt because it had the same version as before it went for repair)

Came back, i spoke to them and they said they tested it and it was fine.

I tried it and exactly the same!

how long are you leaving GPS to lock?

Well i did a 58 mile ride and didnt lock a signal once.

Downloaded GPS status as someone else recommeded it didnt do anything to help.

Has it just developed the fault or has it always been there? And have you Google'd to see if this is a known issue?

Speak to CAB as it sounds like you're not going to get anywhere as it currently stands.

Had the fault for about a month but i kept trying hoping it would work.

Common fault with GPS apparently.

It is a common fault and can be cured with software. Cut o2 out of the equation and go straight to HTC they will fix though if they decide your paying for the repair and you decline they will charge you a £25 admin fee anyway.

I'd say you could argue that the goods were inherently faulty, which gives you grounds to ask for a replacement under the sales of goods act.

You have a 24 month contract, the equipment purchased is not fit for this purpose.

Talk with trading standards & they will give you some pointers on how to go about things. IE who to contact


Also you should ensure any replacement is like for like - so only accept a refurbished item if the warranty terms are as per the original sale agreement

Hi mate... Heres my advice

Jib O2 off and go direct to HTC. Also see where authorised repairs are in the UK. I used to do this with Carphone Warehouse when I couldnt fix complex problems on Nokia phones

Personally, id make a formal complaint with o2, take it as high as you can.

If the phone was a year old, that wouldnt be a bad offer, but only being 3 months old isnt really on.

Sack o2 off seriously. They offer a 30day exchange policy as does every operator. The warrenty provided is done so by HTC and its a year long. Send direct to HTC.

Actually I think you can flash a RUU Rom through fastboot without having to be rooted which would give you a fresh set of GPS drivers. Maybe worth a shot as this will not void your warranty and will put you on the latest software.

Same happened with my old Nokia they wouldn't replace it after 30 days and told me to try Nokia directly isntead of o2. Did that and they replaced it as they also guarantee the phone along with the retailer and their guarantee is usually a lot longer.

escalate complaints with o2, just be a twat to them until the cannot be arsed with you anymore and give-in
